Supreme Court on Thursday said that if the Special Court has taken cognizance of the complaint, then the investigating agency ED cannot arrest the accused under the provisions of PMLA i.e. money laundering. The Supreme Court has made it clear in its important decision that if any accused in a money laundering case has not been arrested by the ED during the investigation and the PMLA court takes cognizance of the charge sheet and issues summons to him, then after appearing in the court, he will be arrested by the PMLA. There will be no need to fulfill the double condition of bail under this.
