Former Shanzu Magistrate and Kiembeni Police OCs on Spot For Freeing Mombasa Business Man Suspected Child Defiler.
The two former Shanzu magistrates and Kiembeni Police were bribed millions to ensure a defilement case against them Mombasa businessman Lameck Olouch was withdrawn from the court under unclear circumstances without the knowledge of the victim and witnesses.
The Suspect, Lameck Olouch, the Director of CAPRICORN FREIGHT FORWARDERS LIMITED of limited dealing with clearing and forwarding also construction and supply, was arrested and Charged on 23rd September 2019 for kidnapping and defiling a child aged 16 years infecting her sexually transmitted disease case file No 119/19.
According to the charge sheet, the suspect, on the 23rd day of September 2019, in the Mtopanga area, Bamburi location in the Kisauni sub-county within Mombasa county, intentionally forced his penis to penetrate the vagina of a child named S. W, aged 16 years.
The alternative charge read that suspect Lameck Olouch intentionally and unlawfully touched the Vagina of S. W, a child aged 16 years, with his penis.
The police report presented in court indicated that on 23rd September 2019, while driving in his car, KAN 700Q found a child walking within the Mtopanga area, forced the child into his car, and defiled her while covering her mouth.
After committing cruelty to the child, the suspect threw her out of the car, dumping her.
The child, who was bleeding from her private parts and crying, was rescued by members of the public.
Upon interrogation, the victim minor told members of the public that the defiler was a person well known to her as Lameck Olouch Mombasa Business Man
Members of the public stormed the suspect’s house, baying for his blood and threatening to torch the house while he had locked himself.
The suspect was rescued by police on patrol who booked him at Junda police station where he spent a night
He was later transferred to Kiembeni Police Station and later charged at Shanzu Court 2.
To the shock of children’s welfare lobby groups, the suspect, after being charged at Shanzu Court, was released on a meer cash bail of cash 30k by a former Shanzu magistrate.
The case was set for mention on 4th/10/2019 for pretrial, and upon mention, the hearing was set for 19th/12/2019.
On 19th/12/2019, the hearing did not take place, and the case was set for another mentioned on 28th/1/2020, the date the case was withdrawn under section 87(a) of CPA.
The Child Lobby groups are questioning why the Shanzu magistrate did not issue sermons to the Kiembeni Police investigation officer to bring the victim and witnesses to court.
The lobby group alleges that they have evidence that the businessman used his businessman friend from Mtwapa to bribe former Kiembeni OCs Ksh 2 million and 3 million to the magistrate for him to get away with a defilement case.
“Since we have acquired evidence of his bribery at Kiembeni police and Shanzu court.
We shall petition the Judiciary Service Commission, IPOA, and EACC to investigate the two involved”.
The businessman claims he is untouchable because he is a friend to former prime minister Raila Odinga and President Ruto.
“We have information this is not the first defilement and rape case.
Many children and vulnerable women within Mtopanga Kisauni are victims of his heinous action”.
The Lobby group alleges his friend residing in Mtwapa, who is a licenced gun holder with two guns whom he uses to intimidate anyone who questions or reports to the Police his cruelty.
When he was arrested, he called the same friend from Mtwapa who came to scare members of the public who had surrounded his house.
When contacted to give his side version of the story, he arrogantly told the media to publish whatever they felt.
The businessman Bragg owns a bungalow with 200 rooms, and he is constructing another 40-roomed mansion within Shanzu.
Sources reveal that the businessman company Capricorn Freight Forwarders Limited was awarded a Ksh 500 million tender by Tana River County to construct the governor’s residence.
“We call upon cancellation of the said tender as a businessman is using the money to buy freedom.
We are appealing to EACC and asset and recovery authority to investigate the businessman how who acquired his wealth since we have information he was among business people who looted from Athriver cement by supply air.
