He secured a $1 million investment from all five Sharks for 30% equity. However, the product later faced issues due to inaccurate readings, leading to a Federal Trade Commission settlement requiring refunds to customers. As of 2023, Breathometer is no longer available, and Mark Cuban has referred to it as his worst investment on the show.
